By accessing or using ProofOfDebt ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

ProofOfDebt provides documentation templates and timeline tracking tools for consumer debt correspondence. The Service compiles standardized letters based on user-provided information and provisions of federal law.

3. Not Legal Advice

The Service provides templates and documentation tools only. Nothing provided by the Service constitutes legal advice, and no attorney-client relationship is created by using the Service. The templates are based on general provisions of federal law and may not be appropriate for your specific situation.

4. Not Credit Repair

ProofOfDebt is not a credit repair organization as defined under the Credit Repair Organizations Act. We do not promise to improve your credit score, remove items from your credit report, or achieve any specific outcome. We provide documentation templates only.

5. User Responsibilities

You are responsible for:

• Providing accurate information when using the Service
• Understanding that templates are for documentation purposes only
• Seeking legal advice for your specific situation if needed
• Complying with all applicable laws when using the Service
• Maintaining the security of your account or session

6. No Guarantees

We make no guarantees regarding the outcome of using our templates. Results depend on your specific circumstances, the accuracy of information you provide, and factors outside our control. Using the Service does not guarantee that debts will be validated, invalidated, or removed from credit reports.

7. Payment Terms and Refund Policy

Certain features of the Service require a one-time payment. Payments are processed securely through Stripe.

No Refund Policy: Due to the nature of digital documentation services, all purchases are final and non-refundable once payment is completed. By completing your purchase, you acknowledge and agree that:

• You have had the opportunity to review our service, disclaimers, and limitations
• You understand that we provide documentation templates only, not legal advice
• You understand that no specific outcome is guaranteed
• You accept that all sales are final with no refunds
• You have read and agree to these Terms of Service

We encourage you to use the preview feature to review our templates before purchasing. The preview allows you to see exactly what you will receive.

Chargebacks: If you initiate a chargeback or payment dispute after agreeing to these terms, we reserve the right to provide evidence of your agreement to this no-refund policy and may take appropriate legal action to recover the disputed amount plus any associated fees.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROOFOFDEBT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless ProofOfDebt and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another.

10. Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action lawsuit.

Notwithstanding the above, either party may seek injunctive relief in any court of competent jurisdiction.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13. Entire Agreement

These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement between you and ProofOfDebt regarding your use of the Service and supersede all prior agreements and understandings.

14. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.
